Terms of Service

By using visualpropertyagent.com (the “Service”) you agree to these terms. If you are using the Service on behalf of a brokerage or company, you confirm you are authorised to bind it.
1. The Service
Visual Property Agent provides software tools that enhance real estate photos and generate video tours from them. Free features may be used without an account; paid plans require an account and are billed as described on the pricing page.
2. Your content
You keep all rights to the photos you upload and the images and videos you export. You confirm you have the right to use every photo you upload (for example, that you took it or the photographer licensed it to you). You grant us only the limited licence needed to process your files and deliver the results to you.
Showing your results in our own marketing. We would like to show what these tools can actually do, using real results rather than invented ones. You therefore grant us a non-exclusive, worldwide, royalty-free licence to display the images and videos you generate with the Service — including before-and-after pairs — in our own promotional material: this website, our social media accounts, demonstrations and presentations. We may crop or resize them to fit a format, but we will not alter what they show.
What this licence does not allow. It does not let us sell or license your images to anyone else, use them to provide services to another customer, or compete with you. It does not cover your name, your team or brokerage name, your logo, or a property address — we will always ask you first before identifying you or a specific property.
You can opt out at any time, either entirely or for one particular property, by emailing [email protected]. We will stop using the material and remove it from anything we control. Opting out costs you nothing and changes nothing about your plan.
Please make sure you can grant it. Listing photographs are often owned by the photographer rather than the agent, and your photographer’s licence may not extend to marketing use by your suppliers. By leaving this permission in place you confirm you are entitled to grant it. If you are not certain, opt out — we would rather show fewer examples than publish a photograph that belongs to someone else.
How long the permission lasts. It applies to material you create while you are a subscriber. If you opt out, we will make no new marketing use of your material more than 30 days after your request. Material already published before that date may stay where it is — an existing post, a printed brochure — but tell us if a particular item troubles you and we will take it down.
If someone else claims rights in your material. You agree to indemnify us against costs, damages and reasonable legal fees arising from a third-party claim — by a photographer, a property owner or anyone else — relating to material you uploaded or generated here. This is the counterpart to the confirmation above: we rely on it, so it has to carry weight. It applies only to claims about the material itself, not to anything we do wrong on our side. In return, we indemnify you against third-party claims that arise from our own marketing use of your material outside the scope of this licence.
3. Accurate representation
Our tools adjust exposure, color, sharpness and motion; they do not add, remove or invent structural features of a property. You are responsible for complying with your MLS rules, state advertising law and fair-housing law, including any requirement to disclose digitally altered images. Where we provide a “digitally enhanced” label or compliance pack, using it is your responsibility.
4. Plans, billing and cancellation
Paid plans renew automatically each month or year until cancelled. You can cancel at any time from your account page; access continues until the end of the paid period. Monthly usage allowances reset on each billing date and do not roll over. Per-listing passes are one-time purchases valid for 30 days, limited to two per account per calendar month; beyond that a subscription is required. Prices may change with at least 30 days’ notice to existing subscribers.
5. Where we sell
Paid plans and per-listing passes are currently available only to customers established outside the European Union and the United Kingdom. Free accounts, the free tools and the free renders remain available everywhere, including in the EU and the UK. Paid plans are offered to real estate professionals — agents, brokerages and photographers — for use in their business.
This restriction applies uniformly to all EU member states — we do not sell paid plans in any of them, and we make no exceptions between them. The reason is administrative and fiscal: we are not registered for the EU One-Stop-Shop (OSS) VAT scheme, and neither are we registered for UK VAT, where a non-established business must register from its very first sale to a consumer. As a small company we are not currently able to administer VAT registration, collection and reporting across those jurisdictions. Our service is aimed at real estate professionals in the United States.
This limitation is not intended to discriminate against anyone on the basis of nationality, residence or place of establishment. It follows from legal and administrative obligations concerning VAT and the registration of suppliers of digital services in the European Union and the United Kingdom, which we are not currently able to meet. Access to this site, to the free tools and to the free renders is not restricted by country, and we do not block, filter or redirect visitors on the basis of their IP address.

7. Acceptable use
Do not upload content you have no right to use, content that is unlawful, or content depicting people in a way that violates their rights. Do not attempt to reverse-engineer, overload or resell the Service except under a Studio (white-label) plan, which permits resale to your own clients.
8. Availability and support
We aim for the Service to be available at all times but do not guarantee uninterrupted operation. Render times are estimates. Support is by email at [email protected].
9. Disclaimer and limitation of liability
The Service is provided “as is”. To the fullest extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
10. Changes
We may update these terms; material changes will be announced by email or on the site at least 14 days before they take effect.
11. Governing law and disputes
These terms, and any dispute arising out of them, are governed by French law.
Any dispute concerning their interpretation or performance will be brought before the French courts having jurisdiction over the registered office of Made in Serenity. Nothing in this clause prevents either of us from applying to any court with jurisdiction for urgent interim measures.
If you are a customer outside the European Union, nothing in this clause prevents you from bringing a claim against us in the small-claims court of your own place of establishment, for the amounts such courts handle.
